Refunds & Cancellations

7. Service Availability
We strive to provide reliable service, but we cannot guarantee 100% uptime. We aim for 99.9% uptime and will notify you of planned maintenance.

7. Intellectual Property

- OPTO Ownership: We retain rights to our pre-existing technologies, frameworks, open-source components, and the "OPTO" brand.
- Portfolio Rights: We reserve the right to display the work in our portfolio and marketing materials unless a strict NDA allows otherwise.
8. Support & Maintenance
Post-launch support is provided based on your specific support package.
- We do not guarantee 100% uptime for hosting services unless managed by us under an SLA.
- Standard bugs included in the scope are fixed free of charge during the warranty period (typically 30 days post-launch).
- Ongoing maintenance and feature updates are billed separately.
9. Limitation of Liability
To the maximum extent permitted by law, OPTO shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our digital products.
Our total liability to you for any claims arising from these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the claim.
Note: Some jurisdictions don't allow limitations on liability. These limitations may not apply to you.
10. Termination
Termination by Client
You may terminate our engagement at any time by providing written notice as specified in your Service Agreement, subject to payment for work completed.
Termination by OPTO
We may suspend or terminate our services if you:
- Fail to make scheduled payments
- Materially breach these Terms or the Service Agreement
- Request us to perform illegal or unethical acts
- Create a hostile or abusive work environment for our team
11. Changes to Terms
We may update these Terms from time to time. For active client projects, the terms in your specific Service Agreement generally take precedence.

12. Governing Law
